Terms of Service

1. Acceptance of Terms

By accessing or using the Curbswap website, app, or SwapBox™ (together, the “Service”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Curbswap offers (a) a free app with a street-sweeping map, address lookup, parking rules, and sweep reminders and alarms; (b) a subscription service in which vetted drivers relocate your parked car to a legal spot to help you avoid street-sweeping and other parking citations, and document each move with photos and GPS; and (c) the SwapBox™, a smart lockbox that holds your spare key.

Curbswap operates in Los Angeles and is rolling out neighborhood by neighborhood. Moves are available only in neighborhoods we have opened; outside them you may use the free features or join the waitlist.

You can use some features as a guest without an account. Saving vehicles, alarms, scheduling moves, purchases, and SwapBox™ features require an account.

Sweep schedules, parking rules, and reminders are provided for convenience and may be incomplete or out of date. Posted signs and official city rules control. You remain responsible for where your car is parked except while a Curbswap driver is performing a move.

3. Eligibility

You must be at least 18 years old and a legal resident of the United States to create an account. By using the Service you represent and warrant that you meet these requirements.

4. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including SwapBox™ access you grant. Notify us immediately at support@curbswap.co if you suspect unauthorized use.

5. Vehicle Authorization

By adding a vehicle, you represent that you are the registered owner or have the owner’s explicit authorization to let Curbswap drivers operate it, and that the vehicle is currently registered, insured as required by law, and safe and legal to drive. You assume full responsibility for ensuring this authorization is valid and for providing accurate vehicle and location information.

6. Subscriptions & Moves

Moves are available by subscription only. Plans are billed monthly and include a set number of moves per billing month: Basic ($49/month, 4 moves, 1 vehicle), Standard ($79/month, 8 moves, 1 vehicle), and Premium ($149/month, 16 moves, up to 2 vehicles sharing the allotment). Prices and plans may change with notice.

Each scheduled move uses one move from your plan’s allotment. Unused moves do not roll over. If you have used your allotment, you may buy one extra move at a time for $10; extra moves do not roll over.

Subscriptions renew automatically each month until canceled. You can cancel at any time; you keep your remaining moves through the end of the paid period and will not be billed again. Upgrades take effect right away; downgrades take effect at your next renewal.

A move can be changed up to 4 hours before its scheduled time. If you cancel a move, or if we cannot complete it (for example, no driver is available), the move is returned to your allotment, and a paid extra move is refunded to your payment method. Other refunds are issued at our sole discretion in accordance with our Refund Policy.

7. SwapBox™ Device

The SwapBox™ is a one-time device purchase, separate from any subscription, with no monthly device fee. The current early-access price is $45 (regular price $75); the early-access price is limited-time and may end or change. Orders ship now, and you can use your SwapBox™ as soon as it’s paired with the app. Ordering a SwapBox™ does not guarantee moving service until Curbswap opens in your neighborhood.

To have your car moved, you must have a paired SwapBox™ on the vehicle with your spare key inside. You are responsible for installing it as instructed and keeping a working key in it.

You can lock and unlock your SwapBox™ over Bluetooth in the app, and create access codes for people you choose, such as a friend or valet. You are responsible for anyone you give a code to; you can revoke codes at any time. Drivers never receive a code: for a move, the app grants the assigned driver one-time access that works only during that move. Lock and unlock events are recorded in an access log you can view in the app.

Refunds and returns for SwapBox™ purchases are handled under our Refund Policy.

8. Moves, Photos & GPS Proof

Drivers relocate your car to a legal spot near its original location based on the information available at the time of the move. Before and after each move, the driver takes timestamped photos of your vehicle and records GPS, and the parked location becomes your vehicle’s recorded location in the app. You agree that these records may be used to resolve questions, disputes, and claims.

Please remove valuables from your vehicle and tell us about anything a driver should know. Curbswap is not responsible for personal property left in vehicles.

9. Drivers

All Curbswap drivers are vetted, background-checked, and insured. However, Curbswap is not liable for incidental damage, loss of personal property left in vehicles, or citations issued due to inaccurate parking information provided by the customer.

Drivers are paid for completed moves, and receive any tips you choose to give, through Stripe Connect. Drivers who use the driver app also agree to Stripe’s Connected Account terms and to any separate driver agreement with Curbswap.

10. Payments

Payments are processed by Stripe. By purchasing, you authorize us and Stripe to charge your payment method for subscriptions, extra moves, SwapBox™ purchases, and tips you choose to give, plus any applicable taxes.

11. CurbScout Submissions

You keep ownership of the parking-sign photos and details you submit through CurbScout. By submitting them, you grant Curbswap a non-exclusive, worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, display, and share those photos and their details (such as location, time, and sign text) to operate and improve our parking data and the Service, including showing them to other users.

By submitting, you confirm that you took the photo yourself and that it contains no one’s personal information beyond incidental details such as license plates or faces, which Curbswap may blur. We review submissions and may reject or remove any of them at any time. Rewards for submissions, if offered, are subject to the terms shown in the app.

12. Prohibited Uses

You may not use Curbswap for any unlawful purpose, to violate any applicable laws or regulations, to transmit false or misleading information, to add a vehicle you are not authorized to have moved, to tamper with or misuse a SwapBox™, or to interfere with the operation of the platform.

13. Limitation of Liability

To the maximum extent permitted by law, Curbswap and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via the app, website, or email.
